The High Court concluded that "in civil penalty proceedings, courts are not precluded from considering and, if appropriate, imposing penalties that are agreed between the parties" (quote taken from judgment summary). This restored the common practice that had been halted as a result of the Full Federal Court's decision which precluded joint penalty submissions.
